Our products are carefully produced in a busy environment where we handle dairy, gluten, nuts and peanuts as well as many other ingredients. For this reason we cannot guarantee our dairy free, gluten free products and cannot guarantee our non nut/peanut flavours as being free from.

To purchase any of our products you must be within the UK. GELATO JOHN’S LIMITED reserves the right to cancel any transaction without reason.

These terms and conditions govern the sale of products to you by GELATOJOHNS.CO.UK (hereafter “us”). Completion of a transaction (via, web, phone or letter) with Gelatojohns.co.uk by you constitutes an agreement to these Terms and Conditions.

Before purchasing products from GELATO JOHN’S LIMITED please carefully read these conditions.

1. Our contract
You will receive an e-mail from GELATO JOHN’S when placing an order with us, this confirms receipt of your order and details of your order.

2. Delivery
Items sold on the gelatojohns.co.uk website are currently only despatched to locations within the UK.

3. Returns, Warranty and Cancellation Policy
We hope you are completely satisfied with your purchases, but if on an occasion you are not entirely satisfied with our products or our service please let us know so that we can resolve the situation. Please give us the opportunity to resolve any issues that may arise with our products.

Non food products can only be returned within 14 days if they are faulty and with proof of purchase. If proof of purchase is not presented then we have the right to refuse your request.
We do not offer refunds or exchanges on food products for hygiene and safety reasons. Please ensure you purchase the correct items before placing your order. Because our gelato is temperature sensitive we will notify you the day of dispatch and it is the customers responsibility to ensure there is someone to receive the delivery so it can be unpacked and stored accordingly as soon as possible.
In the interest of hygiene all our products cannot be returned unless they are faulty. Our products are consumable and can not be repackaged or resold so we do not offer a full money back guarantee. We can only replace products like for like, so additional items that you would like to order will be treated separately and a new order will be raised.

Warranty: Non food items have a 21 day warranty from the day of purchase against defects in workmanship and material. For food items we do not offer any warranty for hygiene and safety reasons.

This warranty is subject to the Terms and Conditions of purchase set on our website.
Warranty Limitations:
Non Food and Food products: Our warranty does not cover any problems that arise due to improper storage, negligence or misuse of products.

If we deem that the item does not meet the guidelines of our warranty replacement we reserve the right to refuse replacement. Please email our team immediately using the form on our contact page if the product is damaged in any way or has become broken in transit. Please include your order number in all correspondence.

The customer will be responsible for any postage expense incurred when returning goods (including faulty items).
We try to be as accurate as possible with photographs and description of our products, we will notify you if any sizes, colours or designs change.

Your statutory rights or your rights under any contract you may have with us are not affected in this Returns Policy.

4. Pricing and availability
We list availability information for products sold by us on the gelatojohns.co.uk website. We cannot be more specific about availability. Please note that dispatches are not guaranteed dispatch times and should not be relied upon as such. gelatojohns.co.uk reserves the right to change availability and pricing at its sole discretion.

5. Ownership and title
At the point and time at which our product leaves our premises in the UK all ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you.

6. Privacy
GELATO JOHN’S LIMITED are committed to protecting your privacy. We will lawfully use the information that we have collected from you (in accordance with the Data Protection Act 1998).
The information we collect about you will be to process your order and offer your our very best service. Your name, address, phone number and e-mail address is the information we collect about you. We will not pass on your details to any third parties.

We may from time to time inform you of special offers. The personal information which we hold will be held securely in accordance with the law.

7. Electronic Communications
You communicate with us electronically when you buy or send emails to us. You consent to receive communications from us electronically for contractual purposes, and you agree that all agreements, disclosures, notices and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Your statutory rights are not affected on this condition.

8. Losses
GELATO JOHN’S LIMITED will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you submitted your order to us, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us when you submitted your order to us or when a contract for the sale of goods by us to you was formed.GELATO JOHN’S LIMITED does not accept responsibility or liability by law, in any way for death or personal injury caused from the use of our products.

9. Alteration of service or amendments to the conditions
We reserve the right to make changes to our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

10. Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your statutory rights.

11. Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

12. Governing law and jurisdiction
Your relationship with us is governed by and construed in accordance with the laws of the England. The Courts of England shall have exclusive jurisdiction over any disputes arising out of these Terms.
